Court Orders Full Restoration of DACA, Including Accepting Initial Applications

Dear Friend of Immigrants,

We are so excited that for the first time since its attempted termination in 2017, DACA is now open to new applicants! 

On Saturday, December 5, Judge Nicholas George Garaufis of the U.S. District Court for the Eastern District of New York ordered the Trump Administration to fully restore the Deferred Action for Childhood Arrivals (DACA) program, opening the program to new applicants for the first time since 2017.

DHS indicated that it might seek relief from the order, so it is possible that this window of eligibility to apply may close. Nebraska, along with several other states, is part of a lawsuit in federal court seeking to terminate DACA with the next hearing scheduled for December 22, 2020.  The outcome of this lawsuit could further limit the window of eligibility to apply. ILC is deeply disappointed that the Nebraska Attorney General has joined this lawsuit.
